Frequently Asked Questions
Can my employer require me to work standard 9-5 hours?
Only if they can prove those specific hours are a bona fide occupational requirement (BFOR) — meaning the job literally cannot be done at other times. For most office, administrative, and knowledge work, this is very difficult to prove.
Will a flexible schedule accommodation affect my pay?
Not if you're working the same total hours. The accommodation modifies WHEN you work, not HOW MUCH you work. Your employer cannot reduce your pay or benefits because you work different hours as an accommodation.
What if my team needs me available during core hours?
The letter can recommend a schedule that includes core collaboration hours while still providing flexibility. For example, guaranteed availability 10 AM - 2 PM with flexible start/end times around that core.
How is this different from just asking my boss for flexible hours?
A medical accommodation letter creates a legal obligation for your employer to accommodate. Without it, flexible hours are at your employer's discretion. With it, they must accommodate unless they can prove undue hardship — a very high legal bar.
